GENERAL CONDITIONS OF SALE

The general terms and conditions listed here regulate all contracts of sale for the gastronomic, regional and artisanal products from Perigord and its neighbouring departments shown on the web site between the company conserves des ondes, Saint Julien de Lampon, registered in France, and its customers.
These conditions of sale are those in force at the moment of sale. They may be changed without notice and are those that are applicable to all new orders.
The company conserves des ondes is the sole owner of the rights relating to the web site conserves-des-ondes.com of which it is the creator.

Confirmation of the order
Submission of the completed order form by the customer implies full and unconditional acceptance of the following conditions, which are the only ones in force at the time of the order.
The data registered by conserves des ondes constitutes proof of all the transactions between the company and its customers. The details recorded by the electronic automatic payment system shall constitute proof of any financial transaction.
By ordering our products in good time you can avoid the risk of items being out of stock, the possibility of increased transport charges (see Payment) and if you place your order between 1 October and 30 November you will be entitled to a gift.
conserves des ondes reserves the right not to accept payment and thus not to confirm an order for any reason whatsoever, whether in connection with the order itself, a problem with the supply of one or more of the goods, a potential problem in connection with delivery or technical problems.
In any of these cases, conserves des ondes will contact the customer by telephone, mail, fax or email.

Details of the offers
Our regional, artisanal gastronomic products from Perigord are supplied singly or in a variety of packages – cardboard boxes, wicker baskets, wooden cases.
The offers displayed on this web site are neither definitive nor permanent and are valid only for the duration of their appearance on the site.
The photographs shown on this site, with or without text or a description of the products, do not form part of any contract.
All our goods can be shipped worldwide, unless specified to the contrary.

Availability of the offers
These offers are available provided that the goods are in stock and, for some products, only at certain times of the year. This will be made clear in the description of the relevant product.
If any item in a package containing several products cannot be supplied, conserves des ondes will replace it with another of the same or a superior kind.
In all other cases conserves des ondes will communicate with the customer by telephone, mail, fax or email in order to suggest a replacement of a similar or superior nature. The replacement of any missing item will be made only once the customer has agreed to it. In these circumstances the customer is entitled to cancel the order and receive a full refund.

Prices
The price of each product, expressed in euros, is net and includes all taxes, but not the cost of transport. It will remain the same until 31 October of the current year.
Goods are invoiced in euros based on the price indicated on the web site at the time of the order.
The total price includes the cost of the goods, Value Added Tax (TVA), handling charges, packaging and transport.
You can access your invoice by going to your customer account under the heading “track your order”.
All our prices are guaranteed until 31 October of current year unless the rate of VAT is changed.

Value Added Tax (TVA)
For goods to be despatched within France the invoice will include French TVA.
The rates of Value Added Tax are those determined by the European Union.
All gift parcels paid for in France include French TVA

For goods sent to the same address as that on the invoice if despatched to a country other than France within the European Union:
1 if the recipient is not liable for VAT, the invoice will include French TVA
2 if the recipient is liable for VAT, the invoice will not include French TVA provided that the recipient’s identification number (TVA Intercommunitaire) has been sent to us and authenticated.

Invoices for goods despatched to a country outside the European Union will not include any tax or duty.

Payment
All payments must be made in euros.
CONSERVE DES ONDES has chosen the Caisse de Credit Mutuel for its secure online payment system.
Once you have completed your order, enter the number of your bank card and the dates for which it is valid.
The Caisse de Credit Mutuel seeks automatic authorisation from the Groupement des Cartes bancaires. This will be sent to you either in the form of a confirmation, or a receipt summarising the information relevant to the transaction (the number, total, date and merchant’s number) will be sent to you. Once authorisation has been received it will be forwarded to the merchant for information and processing. Your order will then be assembled and despatched.
At no time does conserves des ondes know the details of your bank card and the company has no means of recording it. You can use the following bank cards: EUROCARD/MASTERCARD, VISA, CB.

ATTENTION: All orders sent after 15 December for delivery for Christmas or New Year celebrations are subject to an additional charge; ask us about this.
If you do not wish to pay by bank card, you can choose to pay by a cheque accompanied by a print-out of your order and sent to us by mail; or by telephone, giving us the number of your bank card and the dates of its validity. You will need to confirm a telephone order by mail, fax or email in order for us to process your order.

Delivery charges
These depend on the weight and destination of your parcel.
All our goods can be sent to the following countries unless government restrictions are in force and postal services to those countries are not available at the time of your order.
There is a weight limit of 20kg for Albania, Argentina, Columbia, South Korea, Djibouti, Gibraltar, Greece, Japan, St Marino, Spain, the Netherlands and Sweden.
There is a weight limit of 10kg for Malta, New Caledonia, French Polynesia, Wallis and Futuna.

Delivery Times and Conditions
IMPORTANT
Semi-cooked foods will not be sent between May and September; and no goods will be dispatched from 31 December to 31 January during our annual closure.
Once your order has been received it will be processed as quickly as possible.
Once your payment has been authorised by our secure online payment system we will confirm by email that your order is being processed. Delivery is then guaranteed within 8 working days for addresses in France or abroad except in exceptional circumstances. Deliveries are despatched from Monday to Friday except for public holidays.
The time required for the assembly of goods and their despatch depends on the availability of the goods themselves; the size of the order; the period during which the order has been place; and on force majeure. It may take up to 10 days to process an order for end-of-year delivery.
Special conditions for deliveries outside the European Union:
two days will be required for obtaining the necessary veterinary certificates and customs documents if mandatory, duly stamped by the competent authorities.
No order can be sent until the relevant documents have been received.
IT IS VITALLY IMPORTANT THAT SOMEONE IS AVAILABLE TO RECEIVE ALL GOODS AT THE TIME OF THEIR DELIVERY. IF YOU CANNOT BE AVAILABLE MAKE SURE SOMEONE ELSE IS.
We cannot be held responsible for goods which have been retained by the carrier or the Post Office.
In order that the goods can be delivered as expeditiously as possible, it is imperative that you give us the name, address and telephone number of the recipient.
We recommend that packages not be delivered to a poste restante or a post box. If an individual or a company has a post box (even if the postal address is indicated for the delivery) the package will be delivered to the office where the post box is situated and the postal services will not advise the customer of its arrival there.


Once your order has been despatched by us it will be delivered as follows:


FRANCE by Colissimo Expert within 24 to 48 hours by Chronopost within 24 hours

DOM by Colissimo Expert within 4 to 8 days by Chronopost within 2-3 days

EUROPE by Colissimo Expert Europe within 4 to 6 days by Chronopost within 1 to 2 days

TOM and all other countries except for those places or countries where there are no postal services
by first class post (Service Postal prioritaire) within 4-10 days by Chronopost within 1 to 7 days.

We may well recommend the services of a national or international carrier if we judge that to be in the customer’s best interests.
Delivery of all goods sent by Colissimo Suivi, international postal service or carrier requires a signature acknowledging receipt.
The times given above for delivery are only an indication and are those usually achieved; they cannot be seen as contractual. They are based on a normal working conditions and do not take account of delays caused by force majeure or difficulties encountered by the postal services or the carrier.
Once your parcel has been handed to a post office official or a carrier, the company CONSERVES DES ONDES cannot be held responsible for any delays or for the deterioration of any product occasioned by an excessively long journey, or non-collection of the products by the customer. Any such delays cannot give rise to any withholding of payment, compensation, interest, or the cancellation of an order in progress.
Nevertheless, if your package has not been delivered within 30 days of its despatch (60 days for countries outside the European Union) and once its loss has been established, we will either send another one or reimburse you.
Parcels sent by post are limited to 10kg. For weights above this we use the services of a national or international carrier or transport company. We would be grateful if you would contact us to discuss the best means of transport and the most advantageous rate.
The risks involved in transporting the goods are borne by the customer. When the package arrives, and before it is opened, its condition should be checked. If it has been damaged in any way, such damage should be pointed out to the person making the delivery and the details of such damage must be recorded on the delivery note in his presence.
Furthermore, notification of any damage must be sent in writing within three days to the Post Office or carrier involved, with a copy to CONSERVES DES ONDES.
Once you have this information, please inform us as soon as possible so that we can help you with any claim.

Taxes and Customs Duties
The rate of tax or duty is determined by the European Union.
For destinations outside the European Union and to DOM (Overseas departments) and TOM (Overseas territories)
- all customs duties, taxes, levies and charges are charged to the recipient
All such charges payable are those in force in each country. CONSERVES DES ONDES has no control over them and is not aware of their likely total.
Because customs duties differ in each country every customer is responsible for finding out from the local authorities concerned what regulations apply to the products they wish to order for delivery in the country to which their order is to be sent.

Excise duties on wines and spirits
The rate of tax or duty is determined by the European Union.

Delivery to a country within the European Union
If the recipient does not have bonded goods certification and is not registered with the customs authorities, and if the parcel is a gift, French duties will be included in the invoice.
If the recipient has bonded goods certification and is registered with the customs authorities, the invoice will be free of French duties.

Delivery to a country outside the European Union
The invoice total will be exempt from French duties. Any duties required locally will be charged to the customer.

Abuse of alcohol is dangerous. Consume it in moderation.

Guarantees
All our products are guaranteed and conform to the regulations in force concerning them.
If any article is faulty please return it to us in its original packaging and we will either exchange it, give you a credit note or reimburse you.
The return of any goods cannot give rise to any indemnity, compensation or payment of interest.

Gifts
Because of customs duties and in order not to delay or hinder the despatch of a gift to be sent to a country outside the European Union we are obliged to write the value of the goods on the parcel and also to include the invoice with it.
The greatest possible care is taken in the preparation of your gifts. These parcels will be sent on receipt of your order. Do not forget to send us a greetings card to enclose. 12 euros will be added to each individual parcel for the cost of transport and packing.

Responsibilities
The company CONSERVES DES ONDES undertakes, once an order has been accepted and paid for, to deliver the goods ordered to the customers within the time indicated.
The customer undertakes to give CONSERVES DES ONDES a precise address so that delivery can be effected within the days and times specified.

Satisfaction guaranteed or repayment
By virtue of article L121-16 of the Code du Consommation the customer has seven working days starting from the day of delivery to return the products to CONSERVES DES ONDES to be exchanged or refunded without penalty except for the cost of return.
We cannot accept the returns of goods that have exceeded their use-by-date.
If, in spite of all the precautions we take, a tin has, by accident, both its lids dented, CONSERVES DES ONDES will replace it without transport costs, on condition that the tin is returned to us within a year.
We will reimburse you for unopened packages and goods in their original packaging and the costs of their delivery to you and the costs of your sending them back to us.
If the package and/or goods are returned because you are not satisfied with them, provided they have not been opened and are in their original packaging, we will refund the package and/or goods but the cost of returning them will be at your charge.
If the package and/or goods are returned because the product is faulty we will reimburse the cost of parcel and/or goods, the cost of delivery and the return costs.
Refunds are paid within fifteen days after the goods have been received by us.
In the event of returning goods to CONSERVES DES ONDES, please clearly indicate your name, address, date and number of the order and your telephone number.

Limits of responsibility
The products which we give to the carrier conform to French regulations which are those to which we adhere and are the only ones for which CONSERVES DES ONDES is responsible.
Any product exposed to heat after it has been despatched, or which deteriorates for any reason, cannot be guaranteed by CONSERVES DES ONDES. We recommend that all products be kept in a cool dry place. The transfer of risks on all products begins from the time when they are handed over by CONSERVES DES ONDES to the Post Office or carrier.
It is up to the customer to check on his own responsibility that importing and consuming these goods are in accordance with local regulations.
The customer is responsible for the choice of product, its conservation and its use from the day on which it is delivered.

Disputes
All orders received assume the agreement of the customer and without any reservations to the general sales conditions of sale by CONSERVES DES ONDES.
In the event of a dispute our customer service is at your disposal to settle any differences. In all cases every request for information or any complaint by whatever means whether by letter, email or telephone call will be answered
All complaints will be dealt with within ten days of being received in our office.
In conformity to the law no 80335 of 12 May 1980, all goods sent by CONSERVES DES ONDES remain its property until full and final payment.
Unless otherwise indicated on the invoice full and immediate payment with no discount is required on its receipt. No discount will be given for any other form of payment.
Furthermore, if payment is not made within 30 days from the date on the invoice, a penalty of 20% of the invoice total will be charged (with a minimum of 30 euros).
If payment is late, these penalties will be enforced without prior warning.
Any sums not paid when due will attract interest at 1.5 times the rate of legal interest ruling at the time plus TVA. These penalties will take effect from the date on the invoice.
Any dispute concerning a transaction will be subject to French law (at the tribunal at Sarlat), the sole competent authority to deal with it.

We take great care to protect the personal data you give us in order to process your orders. They are solely for the use of CONSERVES DES ONDES and are not under any circumstances sold, given, ceded or exchanged with anyone.
The data protection law no. 78-17 of 6 January 1978 gives you the right to access, consult, modify, rectify and remove the data you have given us via our customer service.
